Terms of Service

These Terms of Service ("Terms") govern your use of the monitoring services, web platform, and related hardware provided by Pyrworks LLC ("Pyrworks," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms.
1. Service Description
Pyrworks provides temperature monitoring for agricultural hull storage. Our system consists of hardware sensor units deployed at your facility, a base station that relays data to the cloud, and a web platform (Kor) where you can view temperature readings and manage your devices.
The system sends alerts via SMS, email, and phone call when temperature readings exceed configured thresholds.
Important: The Pyrworks monitoring system is a supplemental monitoring tool. It does not replace your existing monitoring practices, safety procedures, or judgment. It is not a fire detection system, a fire prevention system, or a fire alarm. It does not contact emergency services. You are responsible for maintaining your own safety practices and responding to conditions at your facility.
2. Accounts
2.1 Account Creation
Pyrworks uses an admin-managed account model. The Pyrworks administrator creates your account, configures your devices, and provides you with login credentials. There is no self-service signup.
2.2 Account Security
You are responsible for keeping your login credentials secure. Do not share your credentials with unauthorized individuals. Notify us immediately if you believe your account has been compromised.
2.3 Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to the Services or other accounts
- Interfere with or disrupt the Services or servers
- Reverse engineer, decompile, or disassemble any part of the Services
- Use the Services in a way that could damage, disable, or impair them
- Tamper with, relocate, or modify installed sensor hardware without coordination with Pyrworks
3. Hardware and Installation
Pyrworks owns all sensor hardware, base stations, and related equipment deployed at your facility. Hardware is provided as part of the monitoring service and remains the property of Pyrworks.
You agree to:
- Provide reasonable access to your facility for installation, maintenance, and retrieval of equipment
- Provide WiFi access for the base station to connect to the internet
- Not tamper with, relocate, or intentionally damage installed equipment
- Notify Pyrworks promptly if equipment is damaged, displaced, or not functioning
4. Alerts and Notifications
The system delivers alerts through SMS, email, and phone calls. These alerts are informational notifications based on temperature sensor readings. They are not fire alarms and do not trigger any emergency response.
You are responsible for:
- Providing accurate contact information (phone number and email) for alert delivery
- Responding to alerts according to your own safety procedures
- Maintaining your own monitoring practices alongside the Pyrworks system
Alert delivery depends on third-party services (Twilio for SMS and voice, SendGrid for email) and your cellular/internet connectivity. We cannot guarantee that every alert will be delivered successfully or on time.
4.1 SMS and Voice Alert Consent
By opting in to SMS text messages and phone calls on the Notification Settings page, you expressly consent to receive automated temperature alert messages from Pyrworks.
- Message frequency varies depending on temperature alert conditions at your facility.
- Message and data rates may apply.
- You may opt out at any time by updating your notification settings or replying STOP to any SMS message.
- Reply HELP for help, or contact [email protected].
- Carriers are not liable for delayed or undelivered messages.
5. Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by law, Pyrworks disclaims all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the Services will be uninterrupted, timely, secure, or error-free
- Any warranty that sensor readings will be accurate, complete, or reliable under all conditions
- Any warranty that the system will detect all temperature events, anomalies, or dangerous conditions
- Any warranty regarding the performance of third-party services used to deliver alerts
Temperature sensors operate within their rated specifications and are subject to physical limitations. Environmental conditions, equipment failure, connectivity issues, power loss, and other factors may affect system performance. The system supplements your monitoring. It does not guarantee safety outcomes.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Pyrworks LLC, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause of action or theory of liability.
This includes, without limitation, damages for:
- Loss of crops, hull material, equipment, or other property
- Loss of profits, revenue, or business opportunities
- Business interruption or downtime
- Failure of the system to detect or alert on a temperature event
- Delayed, missed, or undelivered alert notifications
- Decisions made or actions taken (or not taken) based on data or alerts from the Services
To the maximum extent permitted by applicable law, Pyrworks' total aggregate liability for all claims arising out of or related to these Terms or the Services shall not exceed the total amount you paid to Pyrworks in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
7. Indemnification
You agree to indemnify, defend, and hold harmless Pyrworks LLC, its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services
- Your violation of these Terms
- Your failure to maintain your own monitoring and safety practices
- Any third-party claims related to conditions at your facility
8. Data Ownership and Use
8.1 Your Data
Temperature data collected from sensors deployed at your facility belongs to you. You may request export of your data at any time.
8.2 Our License to Use Data
You grant Pyrworks a non-exclusive, royalty-free license to use anonymized and aggregated data derived from your sensor readings for the purpose of improving our products and services. This anonymized data will not identify you, your organization, or your facility.
8.3 Data Handling
Our collection, use, and protection of your data is described in our Privacy Policy, which is incorporated into these Terms by reference.
9. Service Availability
We aim to keep the Kor platform and monitoring services available at all times, but we do not guarantee any specific level of uptime or availability. The Services may be temporarily unavailable due to:
- Planned maintenance or upgrades
- Unplanned outages or technical issues
- Third-party service disruptions (cloud infrastructure, SMS/voice providers, internet connectivity)
- Circumstances beyond our reasonable control
We will make reasonable efforts to notify you of planned downtime in advance. We do not provide service level agreements (SLAs) or uptime guarantees at this time.
10. Termination
10.1 Termination by Either Party
Either party may terminate this agreement at any time by providing written notice to the other party. Upon termination:
- Your access to the Kor platform will be deactivated
- Pyrworks will retrieve its hardware from your facility within a reasonable timeframe
- You may request a copy of your data before your account is deactivated
10.2 Termination by Pyrworks
We may suspend or terminate your access immediately if you violate these Terms, if continued service poses a safety concern, or if required by law.
10.3 Survival
Sections 5 (Disclaimer of Warranties), 6 (Limitation of Liability), 7 (Indemnification), 8 (Data Ownership and Use), and 12 (Governing Law) survive termination of these Terms.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new "Last Updated" date and sending notice to the email address associated with your account. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14. Entire Agreement
These Terms, together with the Privacy Policy and any separate service agreement between you and Pyrworks, constitute the entire agreement between you and Pyrworks regarding the Services. These Terms supersede any prior agreements or understandings regarding the Services.
